Terms of Service

1. The Service & your subscription

Handed Card provisions, signs, and hosts Apple Wallet passes on your behalf and delivers updates and notifications to the wallets of people who add your card (“Holders”). Paid plans are billed in advance on a recurring monthly basis through our payment processor. You may cancel at any time; cancellation stops future billing and may deactivate live updates and pass delivery for your card.

Holders are never charged. Only the card owner pays. You will not attempt to charge, or require payment from, any Holder as a condition of receiving or using a pass.

Founding rates. The price confirmed at checkout is charged when your subscription begins and renews monthly until you cancel. A founding rate remains in place while that subscription stays active; cancelling ends that price lock.

Taxes. Listed prices exclude tax. Utah treats prewritten software as taxable regardless of how it is delivered, so sales tax is added where applicable and shown before you confirm. Subscriptions are billed monthly in advance and are not pro-rated or refunded for a partial month; cancelling stops the next charge and you keep the Service until the period ends.

2. Your content and the license you grant us

You retain ownership of your name, business name, logo, images, and other material you submit (“Your Content”). To operate the Service, you grant Handed Card a worldwide, non-exclusive, royalty-free license to host, reproduce, resize, and render Your Content within the passes we generate and their landing pages, for the duration of your account.

You represent and warrant that you own or have all necessary rights to Your Content — including all trademarks, trade names, logos, and likenesses — and that our rendering of it in a pass does not infringe or violate the rights of any third party. You are solely responsible for Your Content.

3. How passes are issued

Passes are issued under Handed Card’s Apple Pass Type ID and signing certificate, which remain under our exclusive control and are never transferred to you. The pass is our product; it references your brand inside it under the license in Section 2. Each pass carries an issuer notice identifying Handed Card and a support contact.

4. Acceptable use & content policy

You agree that your card, announcements, and landing page will not:

• contain illegal, deceptive, fraudulent, or misleading content;
• impersonate another person or business, or use marks or content you are not authorized to use;
• function as pure advertising unrelated to a genuine card/relationship, or as spam;
• contain hateful, harassing, sexually explicit, or otherwise objectionable material;
• attempt to abuse the notification channel or exceed your plan’s broadcast limits.

Passes are revocable. We may edit, suspend, or remove any card, announcement, or account that we reasonably believe violates these Terms or Apple’s requirements, with or without notice.

5. Apple requirements

The Service depends on Apple Wallet and the Apple Developer Program. You acknowledge that:

• Apple may, at its discretion, review any pass and may revoke pass-signing capability, which can interrupt or terminate the Service for reasons outside our control;
• by distributing passes, you grant Apple the right to use images and marks from your pass for Apple’s marketing and promotional purposes, and you confirm you have the rights to grant that use;
• every pass must display accurate support contact information (name, mailing address, phone, and email). Your phone and email remain on the pass; you may keep your own location private because the issuer block carries our legal name and mailing address.
• if the pass identity we sign under ever has to change, Apple treats the result as a new pass — existing Holders would need to add the card again, and we would tell you before that happened.

Apple is not a party to these Terms and has no obligation or liability to you under them. Apple Wallet, Apple Pay and Apple are trademarks of Apple Inc.; Handed Card is an independent product and is not endorsed by or affiliated with Apple.

6. Terms for people who receive a card (Holders)

Apple requires the pass issuer to make end-user terms available with the pass, so these apply to anyone who adds a Handed Card card to their Apple Wallet. If that is you:

• The card is free to you, always. Neither we nor the card owner may charge you anything to receive, keep, or use the pass.
• You control it. Delete the pass in Wallet at any time and updates and notifications stop immediately. Nothing else is required of you, and you never need an account with us.
• What we hold. Only what Apple’s Wallet sends us so updates can be delivered — a device identifier and a push token. Never linked to advertising, never shared with data brokers, never sold, and never handed to the card owner. See the Privacy Policy.
• The content is the card owner’s. Questions about the business, its offers, or an announcement go to the contact details on the back of the pass. Questions about the pass itself come to us at support@handedcard.com.

7. Support responsibility

We are responsible for the pass mechanism — issuing, signing, delivering updates, and the landing page. You are responsible for everything you say through it: the accuracy of your details, your dealings with your Holders, and any warranty or promise you make to them. Keep your phone and email current, because Apple requires the pass to reach a real person. You may hide your saved street/city/state from every public card output; our issuer mailing address remains on the pass for compliance and support.

8. Broadcasts & notifications

Announcements you publish update a field on your pass and generate a lock-screen notification request for registered Holders. Wallet, device settings, network conditions, and the Holder’s choices control whether and when a notification is displayed. This channel is rate-limited per plan and must be used for genuine, pass-relevant updates from you — not for third-party advertising. We may lower limits or pause broadcasts to protect platform integrity.

9. Intellectual property & independent operation

The Handed Card name, original software, interface, and brand assets are owned by us or used under license. Apple, Apple Wallet, and other third-party names, marks, platforms, and services remain the property of their respective owners. References to them describe compatibility or functionality and do not transfer any rights to you or us.

Handed Card is independently operated and is not sponsored by, endorsed by, or affiliated with Apple Inc. or any other digital-business-card provider. You may not use the Service to copy another provider’s content or brand assets, imply an affiliation that does not exist, or remove proprietary notices. Descriptive category terms such as “digital business card” and “Apple Wallet business card” identify the type or compatibility of the Service.

10. Termination

You may delete your account at any time. We may suspend or terminate accounts for violation of these Terms, non-payment, or to comply with Apple or legal requirements. On termination, pass updates cease and passes may become inactive.

11. Disclaimers & liability

The Service is provided “as is,” without warranties of any kind. To the maximum extent permitted by law, Handed Card is not liable for indirect, incidental, or consequential damages, and our total liability is limited to the fees you paid in the twelve months before the claim. We do not promise that every update, location suggestion, or notification will appear on every device. We are not responsible for interruptions or display decisions caused by Apple, carriers, network conditions, device settings, or Holders’ devices.

12. Governing law, changes & contact

These Terms are governed by the laws of the State of Utah, without regard to its conflict-of-laws rules, and any dispute will be brought in the state or federal courts located in Utah. If any provision is unenforceable, the rest stays in force. You may not assign these Terms; we may assign them to a successor to our business. Together with the Privacy Policy they are the entire agreement between us about the Service.
